In consideration of my participation in online coaching I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue Fortify Training, its affiliates, employees and agents from liability from any and all claims including the negligence of Fortify Training, its affiliates, employees and agents, resulting in personal injury, accidents, or illnesses (including death), and property loss arising from, but not limited to, participation in online coaching.

I understand that the validity, interpretation, construction and performance of this Liability Waiver shall be governed by the laws of the State of New York without regard to its conflicts of law principles. By signing this Waiver, I hereby agree to irrevocably submit to the exclusive jurisdiction of the federal courts or, if no federal jurisdiction exists, the state courts, located in Suffolk County, New York for the purposes of any suit, action or other proceeding brought by me or by anyone on my behalf, in any capacity, in regard to this Liability Waiver including all terms herein, and hereby expressly waive, and agree not to assert by way of motion, as a defense or otherwise, in any such suit, action, or proceeding, any claim that I am not personally subject to the jurisdiction of the above-named courts, that the suit, action or proceeding is brought in an inconvenient forum, that the venue of the suit, action or proceeding is improper, or that the terms of this Liability Waiver may not be interpreted or enforced in or by such courts. In addition, I agree to waive a trial by jury.

I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in online personal training.  I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
